Brooklyn, NY—CompassCare CEO, Rev. Jim Harden, sent an open letter to Louisiana Governor Jeff Landry and Attorney General Liz Murrill, thanking them for suing New York State for violations of Louisiana’s state sovereignty. In his letter, Rev. Harden encourages AG Murrill to explore litigation against NY Governor Kathy Hochul and Attorney General Letitia James in their personal capacity, citing concerns that the two may have leveraged the power of their elected offices against states and individuals with whom they disagree.
On September 30, Louisiana, joined by Arkansas and Alabama, filed two lawsuits challenging the interstate distribution of chemical abortion drugs and the state shield laws protecting abortion providers from felony prosecution. In Louisiana v. New York, the three states asked the U.S. Supreme Court for permission to bring an original action against New York, Massachusetts, and California, alleging that their abortion shield laws violate the U.S. Constitution by obstructing other states’ enforcement of their own abortion restrictions. In a separate federal civil suit, Louisiana v. Nouhavandi, the states sued approximately 30 abortion providers and associated entities, alleging a coordinated scheme to prescribe and ship abortion-inducing drugs into states where abortion is prohibited. The states seek injunctive relief, damages, and civil penalties, arguing that the defendants’ conduct constitutes a public nuisance and violates state consumer-protection laws.
Rev. Harden encourages them to take the litigation further, writing, “Louisiana has already challenged the providers and the shield-law states. I respectfully encourage you to investigate the next question: Does the evidence support additional civil claims or referral for federal investigation under RICO or other federal criminal statutes against any individuals or entities knowingly participating in this interstate activity?”
Harden expounds, noting, “New York, as the nation’s abortion headquarters, has declared war on pro-life state sovereignty. Conduct warranting federal scrutiny in this interstate conflict includes the implementation of Shield Laws to prevent your state from pursuing justice on abortionists who break your laws and harm your citizens, born and preborn; refusing to extradite those indicted under felony charges in your state, such as Dr. Margaret Daley Carpenter; and knowingly conspiring to and facilitating the shipment of chemical abortion pills across state lines, conduct interfering with your State’s sovereign authority under the Constitution while violating state laws.”
Supreme Court Justices have already signaled support for Louisiana’s action. On May 14, 2026, dissenting from the SCOTUS’s grant of a stay in Danco Laboratories, LLC v. Louisiana, Justice Clarence Thomas wrote, “Applicants are not entitled to a stay of an adverse court order based on lost profits from their criminal enterprise. They cannot, in any legally relevant sense, be irreparably harmed by a court order that makes it more difficult for them to commit crimes.” Justice Thomas concluded that the Comstock Act makes shipment of mifepristone for use in abortions a federal crime.
Furthermore, Justice Samuel Alito likewise wrote in GenBioPro, Inc. v. Louisiana that “the manufacturers of the drug, including Danco and GenBioPro, are obviously aware of what is going on yet nevertheless supply the drug and reap profits from its felonious use in Louisiana.”
