CompassCare Sues NY Attorney General, “Imminent, Ruinous Legal Action”

Rochester, NY—Tuesday, April 30, 2024, the Thomas More Society (TMS), a public interest law firm based in Chicago, is representing twelve pro-life organizations united to protect their right to save women and babies from chemical abortion. Heartbeat International…CompassCare v James is a verified complaint filed in the New York State Supreme Court in Rochester, NY. CompassCare and the other eleven organizations are suing to block what TMS lawyers refer to as “imminent, ruinous legal action threatened by New York Attorney General Letitia James, against pro-life ministries that offer and/or promote Abortion Pill Reversal (APR).” The 66-page complaint outlines how her threatened prosecution and intimidation of Christian, “pro-life” organizations violates the First and Fourteenth Amendments of the United States Constitution, the New York Constitution, and state civil rights law.

The lawsuit alleges James is intentionally and maliciously using her office to restrict the Constitutional and Civil Rights of Christian pro-life pregnancy centers. Among other things, James’ actions violate their U.S. Constitutional rights and afford them redress under USC 42, Section 1983, otherwise known as the Third KKK Act of 1871.

On April 22, abortion activist politician Letitia James, without any evidence of complaint or injury to women, notified pregnancy centers of her intent to sue within five business days alleging the use of “misleading statements or omissions in the advertising of the Abortion Pill Reversal (“APR”) protocol.”

James intends to file a copycat lawsuit to the one California Attorney General Rob Bonta filed against Heartbeat International and other pro-life pregnancy centers last Fall.

CompassCare CEO, Rev. Jim Harden, comments, “Blue-state AGs like James and Bonta reveal that, for politicians, abortion has never been about choice. Their actions serve only to bar a woman from accessing emergency reproductive health care, forcing her to have an abortion she does not want. Meanwhile, elected officials like AG James use these lawsuits as propaganda for the abortion industry, fabricating a façade of credibility for their lies that natural progesterone therapy, reversing chemical abortion, is unfounded and dangerous to women.”

The lawsuit against James reveals, however, the stubborn fact to the contrary. A 2023 review of 16 studies states, “There is no increased maternal or fetal risk from using bioidentical progesterone in early pregnancy. If a woman has already taken mifepristone for her medication abortion and then changes her mind, timely supplementation with progesterone may allow her pregnancy to continue.”

Heartbeat International’s Abortion Pill Rescue network advertises and refers women to pro-life medical offices like CompassCare, whose medical professionals provide women who have begun the chemical abortion process and changed their mind the opportunity to reverse the effects of the chemical abortion drug, Mifepristone. The complaint reveals that nearly 90% of all women served by CompassCare who wish to reverse the effects of chemical abortion save their pregnancies through the use of natural progesterone therapy.

“If James and Bonta were really interested in protecting women from malpractice and fraud,” Rev. Harden says, “they are suing the wrong people. To our knowledge, pro-life pregnancy centers have never sent a single woman to the emergency room, much less the morgue. Compare that little fact to the billion-dollar abortion empire’s record. Beyond that, according to the federal Comstock Act, nearly all of the 630,000 annual chemical abortions in the U.S. are illegal.”

CompassCare and other Christian pro-life pregnancy centers provide women with informed consent, empowering women with the knowledge of the true risks and side effects of abortion.

Rev. Harden comments, “What pro-abortion politicians like Letitia James do not want the public to know is that, according to medical studies, abortion is attended with a 44% increased risk of breast cancer, a 52% increased risk of future preterm deliveries, and a 5-fold increased risk of suicide.” He continued, “Christians believe that all people are made in the image of God and are therefore equally valuable, deserving of equal protection, from the moment of fertilization. Christian people associate and express this core belief by helping women save their babies from abortion.” The discriminatory actions of blue-state AGs like James should be a major red flag for all Americans wherever they stand on the abortion debate. Conspiring to violate the Constitutional Rights of the politically disfavored minority sets an ominous precedent and if let stand, can only end with the total dismantling of the American Rule of Law.
