Brooklyn, NY—On October 5, 2026, it was reported that New York State’s stockpile of the abortion drug misoprostol expired, necessitating its disposal. Other blue states are navigating the same issue, being forced to dispose of their own stockpiles. Meanwhile, the FDA is scheduled to release a status update on its review of the safety of the chemical abortion drug, mifepristone.
In April of 2023, NY Governor Kathy Hochul announced that the State of New York was going to stockpile 150,000 doses of the abortion drug misoprostol. The purchase was made on April 28, 2023, sourced from Cencora Inc at a price of $9.33 per dose. The purchase was made to address fears that mifepristone would be taken off the market by the FDA, leaving a vacuum in the chemical abortion market. However, mifepristone, though under serious scrutiny by the FDA and state governments, was never taken off the market or regulated federally. The result? NY distributed zero doses before the expiration date of the drug. The entire stockpile will be destroyed.
Other blue states joined NY in stockpiling chemical abortion. California purchased 250,000 pills (out of a plan to purchase 2 million) for $107,000, though the state took measures to distribute the expiring pills to abortion providers in advance of their expiration. Washington State purchased a stockpile in multiple transactions, totaling at least $1.2 million. The first purchase of 30,000 pills has expired and will be destroyed. The subsequent purchase will be returned to the manufacturer for replacements at no cost. Massachusetts stockpiled 15,000 doses, providing a fund to enable abortion providers to acquire the drugs themselves.
Rev. Jim Harden, CEO of CompassCare, says, “The FDA is reviewing the drug, and states such as Louisiana are suing pro-abortion states like NY for enabling criminals to traffic abortion drugs across state lines in violation of state and federal law. And while this is a serious violation of states’ rights, enabled by Gov. Kathy Hochul, her disregard for the safety of women is most troubling.”
Serious adverse effects of chemical abortion have been reported, with studies noting that one in ten women who start the chemical abortion process end up in the emergency room. State of Louisiana v. FDA noted a serious adverse event is “from 1.53 to 2.33 times as likely with remote dispensing as with in-person dispensing.” HHS Secretary Kennedy had announced an FDA review of the abortion drug mifepristone. With little public evidence of progress, the FDA is scheduled to release a progress update on the review on Wednesday, October 7.
Rev. Harden continues, “Kathy Hochul and Letitia James are posturing as champions of women’s rights ahead of the midterm elections. But actions speak louder than words. They are willing to sacrifice any woman’s health on the altar of an abortion trafficking criminal enterprise that gets them re-elected. Chemical abortion causes sepsis, hemorrhaging, and death. Conspiring with the chemical abortion industry to circumvent federal law and violate the Constitutional rights around State sovereignty is cause for a federal investigation into racketeering.”
