The FDA loosened restrictions on mifepristone distribution during the Obama and Biden administrations despite mounting evidence that chemical abortions are sending increasing numbers of women to emergency rooms. Yet instead of urgently completing the promised safety review, the federal government appears to be slow-walking accountability.
In a recent dissenting opinion whereby the Court’s majority permitted chemical abortion companies to continue violating federal and state laws, Justice Alito stated, “there is evidence that FDA leadership has told agency officials to delay that safety review for at least 6 months.”
Justice Thomas, citing the federal Comstock Act, cut directly to the heart of the issue: “[chemical abortion companies] are not entitled to a stay of an adverse court order based on lost profits from their criminal enterprise.”
That is extraordinary language from a sitting Supreme Court justice.
